In addition to the standard AME Info website Terms of Service (which shall, to the extent applicable and construed accordingly, continue to apply in connection with your use of and access to the AME Info jobs website, and your use of the specific services offered by this website), your use of and access to the AME Info jobs website and your use of the specific services offered within it is further subject to the terms and conditions set out below.
AME INFO JOBS WEBSITE: TERMS AND CONDITIONS
The website www.jobs.ameinfo.com (the "Website") is operated by AME Info FZ LLC ("AME Info FZ LLC"). These terms and conditions ("Terms") (in addition to the general Terms of Service relating to the use of and access to the AME Info website, www.ameinfo.com) govern the provision by AME Info FZ LLC to you (whether a recruiter or a jobseeker), and your access to and use, of the following specific services (the "Services") made available through the Website:-
IF YOU ARE A RECRUITER…
- Access to the recruiter section of the Website, ie www.rs.jobs.ameinfo.com, (the "Recruiter Zone");
- Advertising of job vacancies using the self-upload application within the Recruiter Zone ("Job Listings");
- Advertising of Job Listings on the Website for services provided by you or your clients ("Website Advertising");
- Access to the AME Info FZ LLC database of jobseeker/candidate CVs ("Database Access");
- Advertising on mailshots to jobseekers/candidates ("Mailshots");
- Development and maintenance of a Recruiter Micro-site (the "Micro-site"); and
- Any and all other recruitment products and services provided by AME Info FZ LLC for recruiters from time to time.
IF YOU ARE A JOBSEEKER…
- Receive notice of relevant jobs by email;
- Create a profile and publish your CV so that recruiters can search and download your CV; and
- Bookmark job vacancies that interest you, and reply directly to the recruiter advertising a specific job vacancy.
By using any of the Services, you accept and agree to be bound by these Terms.
The information and services available on the Website are provided for the sole purpose of individuals looking for employment and career information and for employers seeking to recruit staff. You may use, print and download information from the Website for these purposes only and for no other personal or commercial purpose whatsoever. You may not otherwise copy, display, transmit, or distribute any material from the Website.
Recruiters and jobseekers need to be aware that this Website operates as a venue only and does not introduce or supply jobseekers to recruiters (or vice-versa). This means that AME Info FZ LLC does not:
- Obtain information for potential recruiters to select suitable jobseekers;
- Obtain confirmation of the identity of a jobseeker or their experience, training, qualifications, etc or, in the case of a recruiter, obtain confirmation or verification of the details of the position being advertised, the salary, terms of employment or engagement, etc;
- Take steps to ensure that the jobseeker and the recruiter are each aware of any legal requirement to be satisfied in order to allow the jobseeker to fill the position being advertised by the recruiter;
- Give any indication or recommendation to recruiters whether jobseekers are suitable (or unsuitable) for any position being advertised by the recruiter; or
- Propose jobseekers to recruiters (or vice-versa) or provide information about one to the other.
As the Website only operates as a venue and does not propose or introduce jobseekers to recruiters or vice versa, it is recommended that, if you are a jobseeker, you undertake all necessary and required steps to verify the details of the position being advertised and ensure your suitability for the position that is advertised or, if you are a recruiter, to ensure a jobseeker's suitability for the position you are advertising.
TERMS SPECIFIC TO RECRUITERS
Within these Terms, "Advertising Material" means any content or material supplied to AME Info FZ LLC by you for inclusion within the Website (including Job Listings and Website Advertising), a Micro-site and/or any Mailshots; "Recruiter" means any person or organisation that orders any of the relevant Services from AME Info FZ LLC on their own account or on behalf of another party (including, for example but not limited to, recruitment agents and employers); and "Sales Order" means an order in a form prescribed by AME Info FZ LLC setting out the Services ordered by, and the cost to, the Recruiter.
Where any of the Services are ordered using an online Sales Order, the acknowledgment email sent to the Recruiter will detail the Services ordered and the rates and will form part of these Terms. Where any Services are provided pursuant to any other form of Sales Order, the Sales Order will detail the Services ordered and the rates and will form part of these Terms.
Access to the Recruiter Zone
AME Info FZ LLC allows the Recruiter to access the Recruiter Zone within the Website on the strict basis that:
(i) The Recruiter's password is kept confidential and is personal to the Recruiter and may not be used by any third party to access the Recruiter Zone, nor should it be shared with or disclosed to any third party. For the avoidance of any doubt, the Recruiter is entirely responsible for any and all activities that occur under the Recruiter's account and/or with use of the Recruiter's password and the Recruiter acknowledges and agrees that AME Info FZ LLC will not be liable for any loss or damages that the Recruiter may suffer or incur as a result of a third party using the Recruiter's password, either with or without the Recruiter's knowledge. If the Recruiter becomes aware that any third party has access to its password, the Recruiter will immediately notify AME Info FZ LLC and AME Info FZ LLC shall provide the Recruiter with a new password as soon as reasonably practicable. The Recruiter shall at all times ensure that its password is kept confidential, safe and secure;
(ii) The Recruiter will not do anything which would assist anyone who is not a registered user of the Service (or any of them) to gain access to the Recruiter Zone; and
(iii) The Recruiter does not maliciously create additional accounts for the purpose of abusing the functionality of the Website or any of the Services, or other users nor does the Recruiter seek to pass itself off as another user.
Submission of Advertising Material
The Recruiter will be solely responsible for uploading Job Listings to the Website in accordance with the procedure for doing the same which is made available on the Website. Publication of any and all Advertising Material (including, for the avoidance of doubt but not limited to, Job Listings) remains at AME Info FZ LLC's sole discretion and AME Info FZ LLC reserves the right without liability to the Recruiter to make any additions, amendments or deletions to the content or formatting of any Advertising Material if such Advertising Material is considered by AME Info FZ LLC to contain any unsuitable, discriminatory or unlawful material or material which is otherwise contrary to these Terms.
The Recruiter will be responsible for ensuring that all information in relation to Advertising Material is lawful, complete, correct, up-to-date and otherwise accurate including in connection with (but not limited to) the content of the Advertising Material, the duration for which the Advertising Material should be available and the categorisation of any Job Listing. The Recruiter agrees and acknowledges that (i) it must not request bank details or other financial information from jobseekers responding to a Job Listing or (ii) it must disclose accurately in a Job Listing all material information relevant to the position / vacancy being advertised and must not withhold or misrepresent any information about such position / vacancy that is reasonably requested by a jobseeker.
AME Info FZ LLC shall not be liable for, nor responsible to the Recruiter (or a Jobseeker) for: (i) checking the correctness of Advertising Material in the form it is received from the Recruiter; (ii) any error in Advertising Material in the form it is received from the Recruiter; (iii) the wording, representation, placement or quality of Advertising Material; (iv) the actual positioning or prominence of Advertising Material when it is included on the Website, in a Mailshot or on a Micro-site (as applicable); (v) the repetition of any error in Advertising Material; or (vi) the distribution of (or ability to access) Advertising Material in a specific geographical area.
The Recruiter grants AME Info FZ LLC a non-exclusive, perpetual, royalty-free, worldwide licence in respect of the Advertising Material (and all content included within the same including (without limitation) the Recruiter's name, trade or service marks and/or other logos) as necessary to allow AME Info FZ LLC to use the same for inclusion on the Website, in Mailshots and/or on a Micro-site (as applicable) and otherwise in connection with the provision of the Services.
The Recruiter hereby warrants, represents and undertakes to AME Info FZ LLC that:
(i) The Advertising Material is correct, up-to-date, accurate and honest and is not contrary to the provisions of any applicable law or regulation, is not libellous, blasphemous, discriminatory, racially inflammatory, offensive or obscene in any way and does not contravene or infringe any third party rights (including without limitation any intellectual property rights);
(ii) Without limiting paragraph (i) above, the Advertising Material will comply with such other guidelines as AME Info FZ LLC may notify to the Recruiter from time to time;
(iii) It has or will have obtained prior to uploading or submitting any Advertising Material all necessary rights, consents, licences, clearances and waivers in relation to the Advertising Material (and all content included within it) to enable AME Info FZ LLC to publish the Advertising Material and otherwise exercise its rights under these Terms in connection with such Advertising Material and, as between AME Info FZ LLC and the Recruiter, the Recruiter shall be solely responsible for any and all payments due to third parties as a result of such publication;
(iv) The Advertising Material will not (and will not be likely to) damage or be prejudicial to the image or reputation of AME Info FZ LLC, the Website or any of the Services;
(v) A Job Listing shall not contain gratuitous use of keywords in job descriptions or job titled ("gratuitous" meaning deliberately inserting words, strings of words, or repeating job titles, with the intention of influencing position the results listing, or increasing the number of page views and every Job Listing must be for a genuine vacancy only, and not for other products or services either relating to or unrelated to recruitment;
(vi) All Advertising Material submitted for publication online will be free of any viruses (meaning any computer code, programming instruction or set of instructions that is intentionally and specifically constructed with the ability to damage, interfere with or otherwise adversely affect computer programs, data files or hardware) and no Advertising Material shall cause any adverse effect in the operation of the Website such that the whole or part of such Website shall be wholly or partially unavailable to users;
(vii) The Recruiter has complied and will comply with the terms of the Data Protection Act 1998 and all relevant requirements of the Privacy and Electronic Communications (EC Directive) Regulations 2003 and any guidance issued by the Information Commissioner (and any similar or equivalent legislation, regulation and/or guidance which may be applicable in the territory in which the same is used, held and/or processed) in relation to obtaining, storing and using any personal data derived from responses to the Job Listing(s) or otherwise in connection with your use of the Services;
(viii) The Recruiter will not send directly or indirectly, a cookie (meaning a packet or piece of data or other information sent by a web server to a client device, to be stored on that client device and which is sent back to that web server each time the client device makes additional requests from that web server) to the device of any user of the Website who accesses or responds to any Advertising Material, irrespective of whether any such device has been enabled by such user to receive cookies;
(ix) AME Info FZ LLC reserves the right in its sole discretion and without liability to the Recruiter to remove or reject any Advertising Material that it considers unlawful, discriminatory, unsuitable or otherwise contrary to these Terms and to remove or reject any Advertising Material for any Recruiter who has not paid any sums due to AME Info FZ LLC for any of the Services. The Recruiter shall remain liable for all charges. Any acceptance of a Sales Order by AME Info FZ LLC shall not be deemed to constitute an acceptance by AME Info FZ LLC that Advertising Material is provided in accordance with these Terms and shall not constitute a waiver of AME Info FZ LLC's rights hereunder;
(x) If, for any reason, AME Info FZ LLC believes that the Recruiter has not complied with these Terms or is abusing the Services (or any of them) in any way, AME Info FZ LLC may, at its discretion, cancel, suspend or otherwise restrict the Recruiter's access to the Services immediately and without giving the Recruiter any advance notice and remove any Advertising Material posted by the Recruiter;
(xi) To enable AME Info FZ LLC to provide Website Advertising, Micro-site or Mailshots, the Customer must provide Advertising Material compliant with these Terms not less than four (4) working days before the date upon which the Website Advertising, Micro-site or Mailshot is planned to go live. The Customer accepts that AME Info FZ LLC shall have no liability for failure to meet agreed dates where compliant Advertising Material is not supplied on time and that it may continue to be liable for the amount set out in the Sales Order; and
(xii) It shall deal fairly and professionally with individuals who may respond to a Job Listing and do nothing (or omit to do anything) which may bring AME Info FZ LLC or the Website or any of the Services into disrepute.
All rights in and to AME Info FZ LLC's database of jobseeker/candidate CVs shall belong to AME Info FZ LLC and the Recruiter acknowledges and accepts that it acquires no rights to any of the data contained within the database or to the database (or any part of it) itself, except as provided hereunder. Where this Service is provided to a Recruiter, AME Info FZ LLC grants to the Recruiter a revocable, non-exclusive, royalty-free, worldwide licence to use the database only for the following purposes:-
(i) To search the database for the purpose of identifying suitable candidates for specific job vacancies advertised on the Website and to download the CV of any such suitable candidate for the purpose of considering that candidate for a specific job vacancy; and
(ii) Contacting suitable candidates in relation to specific job vacancies advertised on the Website.
For the avoidance of doubt, the Recruiter is not permitted to supply, sell or license any data contained in the database (or copies of it), or transfer any right it has to access the database pursuant to these Terms, to any other person. The Recruiter shall not contact (or permit or procure others to contact) any persons whose details appear on the database other than for the purpose of contacting suitable candidates for specific job vacancies advertised on the Website. The Recruiter must not download the database (or any part of it) through any automated (eg, "scraping") process and must not retain copies of data or other information that is accessed or acquired from the database for a period of time that is in excess of the period of time which is reasonable to complete the purposes referred to above for which such access to the database is permitted by AME Info FZ LLC. The Recruiter shall further ensure that it deletes all material from the candidate database upon its replacement with up-to-date material or the satisfactory conclusion of the Recruiter's search for a suitable candidate for a specific job vacancy, whichever occurs first
The Recruiter warrants that it will comply with its obligations under the UK Data Protection Act 1998 and any other applicable laws, regulations or codes governing the processing of Personal Data (as defined in the UK's Data Protection Act 1998) wherever in the world and further warrants that it has in place appropriate technical and organisational measures to prevent the unauthorised or unlawful processing of Personal Data.
Commencement of the Service
AME Info FZ LLC will not commence the provision of a Service pursuant to a Sales Order until the Recruiter has returned or otherwise acknowledged the applicable Sales Order confirming that it is correct and that the Recruiter has read and accepted these Terms.
Prices and Payment
The payment terms may vary depending on what payment method the Recruiter uses.
In relation to Job Listings, Recruiters may purchase credits to allow them to upload Job Listings to the Website. Credits may be used within 12 months from the date they are purchased. Job Listings will remain live for thirty (30) from the date first uploaded (or such shorter time as AME Info FZ LLC agrees with the Recruiter). Any extension of this time will be charged as a new Job Listing.
If any Services are to be used within any time period specified in the Sales Order are not used within that period of time, or any prepaid credits are not used within the period of time for which they remain valid, they may not be carried over into any subsequent period without AME Info FZ LLC's express prior written consent.
In relation to other Advertising Material (ie, other than Job Listings), the nature and extent of the Services ordered and the charges the Recruiter has agreed to pay are set out on the Sales Order, which forms part of these Terms.
1. Online Prepayment Using Worldpay
All Job Listings are accepted on the basis that they will be paid for at the applicable rates set out on the Website or which are otherwise notified to the Recruiter when the Recruiter submits its order and will be confirmed online once the order process has been completed. Payment shall be taken by credit/debit card at the time the Recruiter's order is received by AME Info FZ LLC. If AME Info FZ LLC is unable to fulfil the Recruiter's order, AME INFO FZ LLC will contact the Recruiter and the Recruiter will be refunded any payment it has made in accordance with AME Info FZ LLC's normal refund policy. AME Info FZ LLC accepts the following cards: Visa, Mastercard, Solo and Maestro. All payments shall be made in US dollars and without deduction or withholding of any fund, other than as required by law.
2. Prepayment by Telephone
All Job Listings are accepted on the basis that they will be paid for at the applicable rates set out in the Sales Order sent to the Recruiter when AME Info FZ LLC acknowledges its order. Payment shall be taken by credit/debit card at the time the Recruiter's order is received by AME Info FZ LLC. If AME Info FZ LLC is unable to fulfil the Recruiter's order, AME Info FZ LLC will contact the Recruiter and the Recruiter will be refunded any payment it has made in accordance with AME Info FZ LLC's normal refund policy. AME Info FZ LLC accepts the following cards: Visa, Mastercard, Solo and Maestro. All payments shall be made in US dollars and without deduction or withholding of any fund, other than as required by law.
3. Recruiters with Customer Accounts
By prior written agreement, AME Info FZ LLC may permit the Recruiter to order Services on account. The Recruiter will need to contact AME Info FZ LLC to arrange this. AME Info FZ LLC may undertake a credit reference check against the Recruiter's name before agreeing to this. Where AME Info FZ LLC does agree to this arrangement, all Job Listings and other Advertising Material are accepted on the basis that they will be paid for at the applicable rates set out on the Website or which are otherwise notified to the Recruiter in the Sales Order sent to the Recruiter when AME Info FZ LLC acknowledge its order. AME Info FZ LLC agrees to invoice the Recruiter and the Recruiter agrees to pay AME Info FZ LLC in accordance with the terms set out within the Sales Order or which are otherwise notified to the Recruiter. Late payment will entitle AME Info FZ LLC to suspend without notice the Recruiter's access to the Website and/or its use of any or all of the Services and charge interest on any outstanding sums at the rate of 3% over [Royal Bank of Scotland] base rate until payment in full is received. All payments shall be made in US dollars and without deduction or withholding of any fund, other than as required by law.
Cancellation and Refund Policy
In respect of any Services cancelled by the Recruiter after AME Info FZ LLC has accepted the Recruiter's order, the Recruiter will be liable for the full cost of the Services.
In respect of any Services cancelled by the Recruiter before AME Info FZ LLC has accepted the Recruiter's order, AME Info FZ LLC may at its discretion provide the Recruiter with a refund of such payments made and received by AME Info FZ LLC, subject to deducting any reasonable costs that AME Info FZ LLC may have incurred.
Refunds may occasionally be offered at the discretion of AME Info FZ LLC's management.
In the event that AME Info FZ LLC's publication of the Website, Micro-site or Mailshots is restricted, curtailed or prevented by any applicable law or regulation or any other act or thing beyond AME Info FZ LLC's control, AME Info FZ LLC may terminate this Agreement forthwith (in whole or in part) without prejudice to AME Info FZ LLC's right to be paid any monies due as at the date of termination.
AME Info FZ LLC accepts no liability for (i) any delay or disruption whilst accessing the Website and/or using any of the Services; or (ii) any loss or damage to any Advertising Material; or (iii) any loss or damage caused by any error or technical fault in respect of the submission of any Advertising Material by or on behalf of the Recruiter.
AME Info FZ LLC shall not be responsible for any addition or amendment to, deletions from, delays in publication or withdrawal of any Advertising Material required by any competent authority having responsibility for the regulation of online recruitment advertising or otherwise by AME Info FZ LLC pursuant to these Terms.
TERMS SPECIFIC TO JOBSEEKERS / CANDIDATES
Again, and for the avoidance of any doubt, these specific Terms apply in addition to the general Terms of Service relating to the use of and access to the AME Info website, www.ameinfo.com.
With these Terms "Jobseeker" means an individual accessing and/or using the Website for the purposes of seeking employment.
AME Info FZ LLC allows the Jobseeker to access the Website and use the relevant Services on the strict basis that:
(i) The Jobseeker's password and login details are kept confidential and are personal to the Jobseeker and may not be used by any third party, nor should they be shared with or disclosed to any third party. If the Jobseeker becomes aware that any third party has access to its password and login details, the Jobseeker will immediately notify AME Info FZ LLC and AME Info FZ LLC shall provide the Jobseeker with a new password and login details as soon as reasonably practicable. The Jobseeker shall at all times ensure that his or her password and login details are kept confidential, safe and secure; and
(ii) The Jobseeker does not maliciously create additional accounts for the purpose of abusing the functionality of the Website or any of the Services, or other users.
(i) by creating a profile on the Website and uploading a CV to the Website, the Jobseeker is permitting AME Info FZ LLC to: (a) make the CV available via the Recruiter Zone of the Website to Recruiters (defined above) for Recruiters to search and download; and (b) transfer to a Recruiter who has downloaded a copy of the Jobseeker's CV from the Recruiter Zone the Jobseeker's registration details supplied in creating a profile on the Website; and
(ii) if the Jobseeker responds to a Job Listing (defined above) then AME Info FZ LLC shall be entitled to transfer to the Recruiter that had placed the Job Listing the Jobseeker's registration details supplied in creating a profile on the Website.
If, for any reason, AME Info FZ LLC believes that the Jobseeker has not complied with these Terms or is abusing the Services (or any of them) in any way, AME Info FZ LLC may, at its discretion, cancel, suspend or otherwise restrict the Jobseeker's access to the Services immediately and without giving the Jobseeker any advance notice and remove the Jobseeker's CV and other material posted by the Jobseeker.
The Jobseeker agrees that he or she shall deal fairly and professionally with Recruiters and do nothing (or omit to do anything) which may bring AME Info FZ LLC or the Website or any of the Services into disrepute
General Terms (applicable whether you are a Recruiter or a Jobseeker)
Liability & Indemnity
AME Info FZ LLC does not guarantee the continued and uninterrupted availability of the Website or any of the Services and accepts no liability for any unavailability due to (for example, but without limitation) technical errors or faults. In any event, AME Info FZ LLC shall have no liability for any failure or delay affecting the access to or transmission or receipt of any Website or Micro-site and any Advertising Material incorporated in it, in any manner where such failure or delay results from any act, omission, interruption, fault or other condition beyond the reasonable control of AME Info FZ LLC.
AME Info FZ LLC shall not be liable in contract, delict (including negligence) or for breach of statutory duty or in any other way for any economic losses (including without limitation, loss of revenues or profits, contracts, business or anticipated savings), any loss of goodwill or reputation or opportunity or any indirect or consequential losses (in each case whether or not such losses were reasonably foreseeable or avoidable) suffered or incurred by you arising out of or in connection with any matter hereunder including in particular (but not limited to) your access to the Website and your use of the Services. For the avoidance of doubt, nothing in these Terms shall operate to limit or exclude AME Info FZ LLC's liability for death or personal injury resulting from its own negligence or for fraud.
You will indemnify AME Info FZ LLC and agree to keep AME Info FZ LLC indemnified on demand against all claims, costs, proceedings, demands, losses, damages, expenses or liability (including without limitation any consequential losses or loss of profit and any legal fees) whatsoever arising directly or indirectly as a result of any breach or non-performance or non-observance of any of the representations, warranties or other terms contained herein or implied by law and in particular (but without limitation), in the case of Recruiters, as a result of the use or publication of the Job Listing or any Advertising Material by AME Info FZ LLC and as a result of any claims made to or against AME Info FZ LLC by individuals (including Jobseekers) as a result of the Recruiter's breach of the obligation to deal with such individual fairly and professionally.
Other General Terms
If making the Services or the Website, or any part of it, available in your jurisdiction or to you is illegal, you may not access or use the Services or the Website. If you are resident outside of the UAE you must satisfy yourself that you are lawfully able to access or use the Services. AME Info FZ LLC accepts no liability for any costs, losses or damages resulting from or in relation to access of the Website or Services by persons in jurisdictions outside of the United Arab Emirates.
Force Majeure – AME Info FZ LLC shall have no liability to you for any interruptions or delay in relation to the Website or the Services including, but not limited to, strikes, industrial disputes, war, riot, compliance with any law or governmental order or rule, fire, flood or storm.
Law – These Terms shall be governed by the laws of Dubai and the laws of the United Arab Emirates and you hereby submit to the exclusive jurisdiction of the courts of Dubai in relation to any dispute regarding these Terms.
Severability – If for any reason a court of competent jurisdiction finds any provision of these Terms to be unenforceable, that provision will be enforced to the maximum extent permissible so as to effect the intent of the parties and the remainder of these Terms will continue in full force and effect.
Waiver – Failure by either party to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. AME Info FZ LLC does not waive any of its rights to enforce any provisions of these Terms unless that waiver is in writing.
Notices – Any formal notices to AME Info FZ LLC should be sent to AME Info FZ LLC at Al Thuraya Tower 1, 20th Floor, PO Box 502100, Dubai Media City, United Arab Emirates.
Assignment – AME Info FZ LLC may assign, novate or subcontract any or all of its rights under these Terms at any time. You shall not be allowed to assign, novate or subcontract any rights or obligations under these Terms without the express prior written consent of AME Info FZ LLC.
