Our client consists of a number of subsidiaries that are predominantly involved in the contracting/construction industry - civil/infrastructure (water, sewage, roads and related)
Reporting to the CEO, you will be responsible for providing both pre and post contract contractual/commercial services to the Group companies as necessary/requested, resulting in managed risk and optimum financial gain. Maintains a continuing review of the progress of each contract and provides management with information regarding any financial, legal, or technical difficulties and prepares change orders or contract modification proposals; negotiates with clients and handles claims/settlements.
You will be responsible for developing, implementing and maintaining policies & procedures related to the function that complies with business/operational requirements and that is in compliance with ISO certification requirements, take full responsibility for all the contractual/commercial activities across all companies in the Group, and ensures professional administration of the departments’ contractual obligations, advises Management on all contractual/commercial matters, prepares, reviews and negotiates Pre-Bid Agreements, Memorandums of Understanding Consortium/Joint Venture Agreements and other contracts, provides contractual services and advice during the tender process including detailed contractual review, risk identification and qualification, responsible for contract negotiations and the finalization of contract terms with clients and subcontractors, reviews and comments on the text of bonds, warranties and guarantees, provide advice and support in connection with the drafting of joint venture, consortium, and subcontract agreements, claim preparation and defense as necessary and management of Arbitration and/or Dispute Resolution, if necessary, including interfacing with internal/external legal counsel.
You will have extensive experience in all pre-contract aspects including tender documentation, tender evaluation and award. Extensive post-contract experience in all aspects of contract/subcontract management, as well as claim preparation and defense. Excellent appreciation of all standard forms of contract (FIDIC, NEC, etc) and their administration, as well as the ability to readily produce ad-hoc contracts/subcontracts particularly suited to the vagaries of contracting in the Middle East. Keen analytical and problem-solving abilities with a particular flair for quickly analyzing, devising and implementing contractual, as well as practical, strategies for successful resolution of construction problems, claims and disputes.
To qualify you will have a minimum 10 – 15 years experience in a contractual/commercial capacity, preferably in the Middle East. You must possess a BSC Quantity Surveying and/or RICS qualification. It is essential that the candidates have experience in the civil/infrastructure industry working with contracting companies, and it would be ideal if you come from a multidisciplinary background.
